Terms of Service

All reservations at The Rosarium Estate are subject to the following terms:

• Deposit: A non-refundable deposit of 25% of the total booking amount is required to secure your reservation. Your booking is not confirmed until the deposit is received and acknowledged.
• Full Payment: The remaining balance is due no later than 14 days prior to your scheduled arrival date. Failure to remit full payment by this deadline may result in cancellation of your reservation.
• Confirmation: Upon receipt of your deposit, you will receive a booking confirmation via email with your reservation details, check-in instructions, and a copy of these Terms of Service.
• Minimum Stay: The minimum booking duration varies by package. Please refer to the specific package details for minimum stay requirements.
• Guest Information: The primary guest must be at least 21 years of age and must provide a valid government-issued ID at check-in.

Cancellations must be submitted in writing via email to [CONTACT EMAIL]. The following refund schedule applies based on the cancellation date relative to the scheduled arrival:

Refunds will be processed to the original payment method within 10 business days. The 25% deposit is non-refundable in all cancellation scenarios except the 30+ day window as described above.

• Check-In: 3:00 PM (CST). Early check-in may be available upon request and is subject to availability.
• Check-Out: 11:00 AM (CST). Late check-out may be arranged in advance and may incur additional fees.
• ID Verification: All guests must present a valid government-issued photo ID at check-in. The primary guest must match the name on the booking.
• Key Access: Access codes or keys will be provided upon check-in. Guests are responsible for securing access credentials during their stay.

To ensure a premium experience for all guests, the following property rules must be observed:

• Maximum Occupancy: The estate accommodates up to 8 overnight guests. The number of guests must not exceed the amount specified at the time of booking. Unauthorized guests are not permitted.
• Noise: Outdoor music and amplified sound must cease by 10:00 PM to respect neighboring properties. Indoor studio recording is available 24/7 with soundproofing.
• Smoking: Smoking (including e-cigarettes and vaporizers) is strictly prohibited inside the estate. Designated outdoor smoking areas are available. A $500 cleaning fee will be assessed for indoor smoking violations.
• Pets: Pets are not permitted on the property unless prior written approval has been obtained. An additional pet deposit of $300 may apply for approved animals. Service animals are welcome in accordance with ADA guidelines.
• Events: Private events, parties, or gatherings exceeding the booked guest count require prior written approval and may incur additional fees.
• Pool & Outdoor Areas: Use of the heated pool, fire pit, and outdoor areas is at your own risk. No glass containers in the pool area. Children must be supervised at all times.

Access to The Rosarium Estate’s recording studio is included in select packages and subject to the following terms:

• Equipment Liability: Guests are responsible for any damage to studio equipment caused by misuse, negligence, or unauthorized modifications. A full equipment inventory will be reviewed at check-in.
• Engineer Availability: A professional recording engineer is available on-call during your stay (included in Recording Retreat and Creative Intensive packages). Additional engineering hours may be booked at prevailing rates.
• Equipment Usage: All studio equipment, instruments, and software must be used in accordance with the orientation provided at check-in. Guests may not remove equipment from the studio without prior authorization.
• Software: Pro Tools, Logic Pro, and Ableton Live are available with premium plugin libraries. Guests may not install additional software on studio computers without approval.
• Session Files: Guests are responsible for backing up their session files before check-out. We will retain session files for 30 days after departure, after which they may be deleted.

We believe your creative work belongs to you. The following terms govern intellectual property during your stay:

• Ownership:All recordings, compositions, and creative works produced by guests during their stay are the sole and exclusive property of the guest/artist. The Rosarium Estate and Rose & Thorn Studios claim no rights, ownership, royalties, or interest in any guest recordings.
• Promotional Use: We may request permission to use brief clips, photos, or testimonials for promotional purposes. Any such use requires your explicit written consent and may be revoked at any time.
• Engineer Contributions: Work performed by our on-call recording engineer is considered work-for-hire on behalf of the guest. The engineer retains no rights to the recordings.
• Third-Party Content: Guests are solely responsible for ensuring they have the right to record, sample, or reproduce any third-party copyrighted material.

• Security Hold:A $5,000 security hold will be placed on the primary guest’s credit card at check-in. This hold is not a charge and will be released within 7 business days after check-out, provided no damage is identified.
• Damage Assessment: The property will be inspected after check-out. If damage beyond normal wear and tear is identified, the cost of repair or replacement will be deducted from the security hold. If damages exceed $5,000, the guest will be invoiced for the remaining balance.
• Reporting: Guests are encouraged to report any existing damage or maintenance issues upon arrival. Pre-existing damage will be documented and not attributed to the guest.
• Lost Items:We are not responsible for personal items left on the property. Found items will be held for 30 days and may be shipped at the guest’s expense upon request.

We expect all guests to treat the property, staff, and neighboring community with respect. We reserve the right to terminate a reservation without refund if guests:

• Engage in illegal activities on the premises
• Cause excessive noise or disturbances after quiet hours
• Damage property intentionally or through gross negligence
• Exceed the approved guest count without authorization
• Violate smoking, pet, or event policies
• Behave in a threatening or abusive manner toward staff or neighbors

In such cases, guests will be asked to vacate the property immediately and may be liable for additional costs.

To the maximum extent permitted by applicable law:

• The Rosarium Estate and Rose & Thorn Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your stay or use of our facilities.
• Our total liability for any claim arising from your booking shall not exceed the total amount paid for the reservation.
• We are not responsible for personal injury, illness, or loss of personal property during your stay, except where caused by our proven negligence.
• Use of the recording studio, pool, outdoor areas, and all amenities is at your own risk.

You agree to indemnify, defend, and hold harmless The Rosarium Estate, Rose & Thorn Studios, and their respective owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:

• Your breach of these Terms of Service
• Your use of the property or studio facilities
• Any damage caused to the property or equipment
• Any injury to third parties during your stay
• Any violation of applicable laws or regulations

Neither party shall be liable for failure to perform obligations under these Terms if such failure results from circumstances beyond reasonable control, including but not limited to: natural disasters, severe weather events, pandemics, government orders, acts of terrorism, fire, flood, or utility failures.

In the event of a force majeure occurrence that prevents your stay, we will work with you in good faith to reschedule your reservation or provide a credit for a future booking. Refund eligibility in force majeure situations will be determined on a case-by-case basis.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Davidson County, Tennessee.

In the event of a dispute arising from these Terms or your stay at The Rosarium Estate, the parties agree to the following resolution process:

1. Informal Resolution: The parties shall first attempt to resolve the dispute through good faith negotiation within 30 days of written notice.
2. Mediation: If informal resolution fails, the dispute shall be submitted to mediation in Nashville, Tennessee, with costs shared equally.
3. Binding Arbitration:If mediation is unsuccessful, the dispute shall be resolved through binding arbitration administered in Nashville, Tennessee, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.

Each party shall bear its own costs and attorney’s fees unless the arbitrator determines otherwise.

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email to guests with active reservations. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these Terms periodically.
